Dear All,

Hope we are all keeping well there.

Basically, I had to apply for second extension as I came to UK 4 months late.

However, I have now become eligible to apply for ILR and I haven't received the outcome of my extension and it is still in process at UKBA (posted 28th Sept, acknowledgement letter receieved, fee debited, biometric done in Oct'12).

Therefore, can I opt to apply through solicitor to vary my application while it is at UKBA so that I could get my passport back the same day or a week later atleast?

I will appreciate your help in this matter.

I don't think you can withdraw your application because then you will be illegally be here in UK?

You can vary your Tier 1 application, which could save you additional fee for ILR. Getting your passport back may result in you application being withdrawn.

It seems variations are tricky... will let you if I went for it.

I would need to involve solicitors (thats for sure).

You haven't given two very important details:

1. Your date of entry (as your date of visa stamp is irrelevant because you entered with 4 mth delay)

2. Your current visa expiry date

In response to your questions, please see below;

(1)- 25th Jan'2008 = Date of Entry

(2)- 1 Oct 2012 (Current visa, which is now expired).

What do you suggest now?
