dO WE NEED TO QUALIFY WITH POINTS AFTER 1+4 YEARS TO GAIN ILR
OR CAN WE APPLY DIRECTLY TO IND FOR INDEFINITE STAY

I WAS TOLD THAT THEY WILL NOT CHECK POINTS AFTER FIVE YEARS ON HSMP

you can directly apply for ILR ( no further points test ).

By the way, is'nt it too early for you to think of 1 + 4 ending ?? ( it is atleast 4 years away, and several rules will be changed by then. )

I have got 1+4 year extention. but I came 2 months late from inital start of visa. So effectly I will not able to complete 5 years of stay or even 28 days pre-date as they suggest before some can apply for ILR. Lot of tricky situations will come for us in 2010.

if you are not 5 years in UK BY THE TIME YOUR VISA EXPIRES, YOU WILL STILL NEED FURTHER EXTENSION before ILR

well, i think there is some grace period allowed for you to be outside UK during those 5 years. i think it is around 90 days, but can't be sure.

That is after you have come into UK. The date at which you arrived in UK and when you are applying for LR. When you ahve come in, then you are allowed some holidays abroad, approximately 30 days a year

I got same question as yours. Can not get 5 years totally.

I remember we were having similar discussions on this board about falling a little short of 4 years after 1+3 for ILR and had concluded that home office would give a couple months grace. Until home office pulled an ugly monster out of its hat. I sincerely wish that you go through to ILR after 1+4 and do not face our fate.

I guess they will be making further changes in the next four years (Making Migration work for Britan, changes to points system etc
