Uk resident marrying a Eu Citzen whats the procdure ?

Hello

Im a uk citizen and are thinking about getting married to my partner to is a fellow Eu citizen (romanian) currently she is in the uk with me but not working. We are unsure of where we find information on what the correct procedure to follow is and what paper work we need.

Do we need visas or permits or is it just the normal case of giving notice to marry etc.

And after we marry where do we go to apply for the papers that will allow my partner to stay in the uk long term and also work freely.

Given that she is now an EU/EEA Citizen, albeit subject to certain transitional arrangements, it is, as you say, " just the normal case of giving notice to marry etc." ..... in order to get married.

Following the marriage she can register using form BR1 to be exempted from the usual no-employment conditions applying to Romanians. That is, following the marriage, she will be able to work.

She might want to apply for a spouse visa (under normal rules) in order to be eligible for permanent residence (ILR) in 2 years, rather than 5 years. This would allow quicker access to British citizenship.

Good question. There used to be a document in the ECIs explaining precisely this scenario but it has apparently been withdrawn "for review".

If she does apply in Romania, the fact she is an EU-member state citizen is no bar to the application. It's an open question as to whether it could be done in the UK - there is clearly no policy reason why it shouldn't be possible. But that doesn't mean that the Home Office have thought through this kind of situation.

It's likely to be some time before visa-free travel on a Romanian passport is anything like that of a British citizen passport, so the shorter time to British citizenship is worth considering. Plus there's the right to vote etc.

Alternatively, assuming there's a legal marriage to a British citizen (not an ILR/ROA holder), then there's the option of using the "ppron method" to apply for naturalisation via a British Embassy outside the UK - eg Dublin or Paris. This could be done after 3 years in the UK on EEA status, no need for ILR.[/i]
