ILR for Tier 1 General Migrant

Hello guys,

Please can someone clarify to me whether I am eligible for applying ILR in May 2013 or not?

Tier 1 General Migrant VISA

21 May 2008 - 20 May 2013

Two periods of absences:

1) 18 Aug 2008 - 10 Feb 2009 - 177 days

Initially, I had an accident and had a fractured leg. Medical from Doctor
Marriage in November 2008 and then we were waiting for the result of the dependant application of my wife. After 5 days of getting the VISA we came to UK i.e. 10 Feb 2009.

I wasn't working during this period.

2) 7 Jan 2012 - 29 Jan 2012 - 22 days

According to the new rules you can. I guess it is better to have medical documents ready.

IMHO, the duration (177 days) of unpaid absence from the country is slightly worrisome as its more than 90 days at a time; but the good thing is that both your reasons - medical treatment & marriage are compassionate in nature.
However, it will be good to understand how would you split 177 days across these 2 reasons? The reason why I ask is, absence due to marriage should be okay and hopefully not questioned by the caseworker but he/she will probably probe deeper into why the medical treatment could not be done in the UK?
So, quality and extent of documentation supporting the travel will be the key here.

Thanks a lot for your response Samira.

Please can you also clarify whether I need to apply ILR for my son also?

He was born over here and currently he is on Tier 1 dependant visa. The reason I asked as I read somewhere that a child who is born in UK will be eligible for citizen if the parents have ILR.
On the other side, I have been advised that if the parents have ILR at the time when child is born then only if the child will be eligible for citizenship else the child will need to apply for PR and then citizenship.

So, if you could clarify the same then that would be helpful.

My marriage was initially scheduled on 20 Sept 2008 but I had an accident a week ago (13 Sept) and plaster was put on my leg for 6 weeks.

The marriage was then postponed and was scheduled for 9 November 2008. After that we applied for dependent visa and were waiting for the reply from home office.

Do you think these reasons would be strong enough to support the application?

You need to put your case in a very 'coherent' letter, and include all evidence.

Re: 'free' healthcare in UK, it is of no use if you are injured overseas...
