Notice Period/ switching from ICT to Tier2 General

Post by itsarnie » Sat Dec 15, 2012 9:44 pm

Hi,

I am switching from ICT to Tier 2 G.
My notice period is 2 months with my current employer. I have made the new visa application without resigning from my current employer.

question1 : Is it legal?
question2 : Will the UKBA inform my current employer about the visa switch?
question3 : Will I be able to serve the notice period after I get the new visa?
Shall I resign before I get the new visa?

Regards,
Arnie.

question1 : Is it legal? yes (presumably you had a CoS from the new employer)

question2 : Will the UKBA inform my current employer about the visa switch? unlikely

question3 : Will I be able to serve the notice period after I get the new visa? this depends what the start date in the new CoS is, you will only be able to continue working for the current sponsor until that date.

Shall I resign before I get the new visa? NO

Arnie.

Many thanks fro the reply.

It is unlikely that I will get the visa before the job start date mentioned in the CoS.

So, does that mean that I can't keep working for my current employer?
