Hello all,

Apologies if this question has been asked earlier and for my lengthy query.
This is regarding points claimed for you previous earnings during extension(tier 1) compared to points claimed during first time tier 1 visa application.

I applied my TIER 1 Visa first time application during March,2011 and has my extension due in March 7,2013.

When I applied in 2011, my previous earnings was 35 points as i was in 55,000 - 60,000 band. My earnings was in USA+India ( during 2010) :
USA : 9 Months earning. USD 45000+ (approx) which is equivalent to GBP 30000 (approx.)
India : 3 Months earning( full time + part time). INR 375000+ (approx) which is equivalent to GBP 5300+ (approx.) and considering the uplift conversion rate of 5.3 for India, the earnings are coming out to GBP 28000+ (approx.).

During that time I had 105 points.

Now while extension, I have 12 months earnings around 43,000 £ which will fetch me 25 points and this will leave me with 95 points ( I need 100) and I can also claim UK experience 5 and just touch 100 Points.

NOW MY MAIN CONCERN is for extension I am claiming only 25 compared to first time Visa application 35!! Will I be denied visa citing reason : "You are making less earnings than your home country income, then how would you consider yourself as a Highly skilled Migrant." as one my friend was indeed denied visa extension for same above said reason.

Though I checked in guidance and nowhere I could see a clause stating points should match compared to First Visa application.

So please someone clarify and let me know if I need to worry for my situation/case.

There is no requirement for you to earn more money in a subsequent application. The only requirement is to meet the points threshold - nothing more.

I couldn't agree more with you Mulderpf. No disrespect to the op, but a lot of people come on the forum scared about things that are non existent without really basing their assertions on facts.

I was jus lil worried, i did read the entire guidance doc but still as my frens visa was denied on the said basis and my case was exactly the same so I was nervous about it and had to put this question across you guys!!!!
And now that you guys have said its not at all an issue as long as I can show 100 points my case is good to go, i am now extremely relieved to know this.

I can say without a shadow of a doubt that your friends visa would not have been denied simply for earning less than in a previous application. Your friend is lying or not telling you the whole truth.

Well he is my frens fren so cant really comment on how genuine his claim is!! But am sure his visa was denied and for same reason i stated above. I dont want to sound ignorant but as it did happen, so in worst case, for my fate, if my case worker reject my application for same reason, can u pls tel wat option wud i be left with?? Its just tht i want to make sure i am well prepared and covered for all scenario as from compared to 35 m claiming only 25 ( from 55000+ coming down to 43000) !!!

Your case cannot be rejected for the reason you mention so please stop asking for an answer when you have already been provided with one.

You need to earn the necessary points to qualify for the extension by being in the right earning band to score the points you need. Any other thing is irrelevant.

Hi,

I can vouch for it now that it doesn't matter i matter if your earning less than your initial application.
For my initial application i was on 40k band. I just had an PEO appointment yesterday and at present i am on 35K band. The case worker didnt even brought up this question. I was granted the visa in 2 hours.
