New Rules, Need help

Post by jsamad » Mon Dec 17, 2012 2:59 pm

Hi,
I came to UK in Feb 2008 on a WP, in 2008 I have 2 breaks from UK not exceeding more than 90days, based on the new rules I should provide evidence for my leaves and I should also be active on the UK Payroll, however those 2 breaks were not paid in UK. So instead of applying in Feb 2013 I am thinking to apply in Sep 2013, as from Sep 2008 I have been in UK and all my leaves have been paid in UK and also I changed my Visa from WP to Tier 1 in May 2009.
So could you please let me know if I apply on Sep 2013 for ILR, would the CS consider my start date as Sep 2008 or would CS still be looking for my 1st entry into UK and would still expect me to get the evidence of my leaves before Sep 2008 ones.
Would appreciate if you could please clarify my Doubt.
Thanks,
Samad

The 5 year continuous period will be counted back from the date of your application and therefore if you apply in Sep 2013, any period or leaves before Sep 2008 will not be included.

Thank you hsmp1412 for clarifying, but when we enter the 1st port of entry date into UK in the Set(O) form, I would still be required to enter the date when I just came into UK right? and that should not be taken as the start date for my continuous 5 year period correct?

I believe that is how it should be.
