@xpert2013,xpert2013 wrote:Hi guys ,
I need a advise from you that I am going to apply indefinite leave to remain on the basis of 10 years long residency in January 2013 , currently I am on Tier 1 general visa along with wife and 5 years old daughter born in UK . We have almost 2 and half years visa left on Tier 1 general . I am now confused that whether I will apply only my ILR on SET(O) form and wait for my ILR and apply for my wife FLR(M) and for daughter British Nationality OR I have to apply for all of my dependants along with my application definitely my will be SET(o) and dependants will be FLR(M) .
Would anyone advise me what option is suitable for me and that will not make any legal problems in future .

Apply for your ILR first, as your wife and daughter already have leave to remain, its best once you have ILR, you can apply for your wife on FLR(M) on a premium service(if you wish).
No need add your daughter in FLR(M) she can apply on MN1(register as British Citizen) as soon as you get ILR.
It depends on individual application, as none are alike.khanjaan wrote:Just wanted to know how many chances are there of refusal after biometrics because biometrics is not guarantee that you will get a visa
As long as you appealed in the tribunal with in 10 working days of refusal, your leave extended by operation of law(section 3C).amjadleeds wrote:Hi everyone,
I applied ILR on basis of 10 years rule, In 2005 case was made against me that you working in breach and not studying due to complaint of one of relative. I m keeping in short case start March 2005 and settle in Dec 2007, my leave expired in March 2006 , I applied for extension even my case was in Court but they not consider due to applied ten day late plus due to case was in court. But after providing all evidences and on full hearing HO took case back and allow me any application you will make will be consider in lane with law. They paid me 10 thousand ex-gradita payment too, if case in court your previous status as it is until final decision , in my case HO took case back, my leave 2005 was valid until decision date ?
Your views will be highly appreciate, I applied ILR OCT 2012 and bio metric done as well, Currently I am on Tier1 valid until April 2013

quick question to spidery_thread and Daminsallo
If they take the date of order from the date biometrics was given, why did they send the biometrics late to all the people who applied from 20th July to 20th August at least a month later than from the date they send it to applicants in 1st week of october. No offence to all those guys who got their Bio - Invite before our "olympic applicants". I am just trying to make a point here
this is what the website says when I read it

Waiting times
Settling in the UK
This page contains our service standards covering applications for settlement made inside the UK. The service standards explain how quickly we aim to decide these applications.
The service standards
We will:
decide 95% of postal applications within six months; and
decide 90% of applications made in person at a public enquiry office within 24 hours.

don't you think this means the date "application was made"
It contradicts with my application:"verycute"]Alhamdulillah my passport and docs were returned today. ILR granted on the 18th of December. I am waiting for the BRP, which I think will arrive tomorrow. Here is my timeline again.
Applied: 20th July 2012, received by HO 23rd July
Acknowlegement letter: dated 8th August, received by me 14th August.
Biometric invitation: dated 9th November, received 13th November and enrolled on the 14th.
ILR granted: 18th December, docs received 20th December (I sent a special delivery envelope when I applied).
BRP: awaited.
I sent life in the UK pass letter, employment letter and payslip with my application.
A person who enrols his bio 2 weeks after me get his decision done with in 5 weeks....!!!!Applied SET(O): 04 July 2012
Ack: 12 July 2012(Dated: 10 July 2012)
Bio: 31 Aug 2012(Dated: 29 Aug 2012), Supplied same day.

Dear Anjum, amjadleeds wrote:Spidery_thread wrote:Anjum I can't guarantee that Section 3C applied to your case unless one reads all of your documents.
When the case was brought against you by HO, did they curtail(cancel) your previous leave?
What did you obtain the leave which expired in March 2006?
Did you request your SAR file from HO before applying for ILR?[/quote
Hi,
They suppose to Revoke my leave, but they didn't because they want to revoke my other family member leave too like my wife and son, but before this thing happen and set moving direction, Tribunal accept my application allow me to carry on my study, on bail , then case carry on on first hearing decision was against me, then full High court hearing by providing all my wage slips and letter from my head of department , plus other evidences, they took case back and pay me ex-gradia payment too.
I got leave in Nov 2007, but I applied in March 2006 only ten day late because my solicitor realise quite late that my leave was valid, even they gave me letter I can work 20 hours during week in 2005.
SAR says nothing clear HO lost some data
My family with in UK last 8 years, I have own house, Own business, in term of private life section.
But my concern if due to any reason not allow me ILR my visa going to finish in April 2013 and I havn't apply for my family with ILR application.
What you think in this scenario

Amjad
