Hi Guys ,
Thanks for your reply .
One more question , when I will get ILR , Is there any specific period like 28 days or any in which my dependent needs to apply for spouse visa OR she can stay on tier 1 general dependent visa as long she wishes ???
Secondly when my application will be in process , would my dependants allow to travel abroad???
khanjaan wrote:Spidery_thread wrote:xpert2013 wrote:Hi guys ,
I need a advise from you that I am going to apply indefinite leave to remain on the basis of 10 years long residency in January 2013 , currently I am on Tier 1 general visa along with wife and 5 years old daughter born in UK . We have almost 2 and half years visa left on Tier 1 general . I am now confused that whether I will apply only my ILR on SET(O) form and wait for my ILR and apply for my wife FLR(M) and for daughter British Nationality OR I have to apply for all of my dependants along with my application definitely my will be SET(o) and dependants will be FLR(M) .
Would anyone advise me what option is suitable for me and that will not make any legal problems in future .
@xpert2013,
Apply for your ILR first, as your wife and daughter already have leave to remain, its best once you have ILR, you can apply for your wife on FLR(M) on a premium service(if you wish).
No need add your daughter in FLR(M) she can apply on MN1(register as British Citizen) as soon as you get ILR.
100% agree with spidery good advice

She can stay on her current leave until she qualifies for ILR. However, she cannot travel on her current leave. I mean in theory she can but may not be able to enter on her current leave.

@clubcard2002,
You need to the claim the damages when appealing or filing a case against HO, this is normaly done at the High Court.
Make sure you have a very good solicitor for representation because some times claiming damages can back fire.
Seek expert legal advise.
Thanks Spidery_thread,
Will look for a good solicitor.
However, this is retrospective. Refusal went to JR back to UT and won with cost awarded in the determination in 2010 but never claimed as I paid solicitor privately. After the ILR I want to claim that, is there a time limit? Is it too long ago?
Thanks,

Dear All,
Please help me to clear some confusion at the SET (O) version 12/2012. I am applying for ILR under 10 years long stay category.
Page 15, Section 7:
Under the title Personal History there is a statement says,
"It is mandatory to complete section 6A. If it is not complete the application will be invalid and will be returned to the applicant". I can not find section 6A on the application form. Or are they talking about the 6A in immigration law.
Page 13, Section 6:
6.3 What evidence has been provided to support the reasons for all absences from the UK?
I have been out of country 4 times visiting my family back home (120 days in total). Do I need to give any evidence for my absence during last 10 years? Or is it only for work related absences for Tier1, Tier2 and Tier5 applicats.

Only for working categories, for 10y LR you only need to put dates going out and coming back into the country.

@ Clubcard2002,
The copy of determination must have been sent to the relevant department of HO at the same time, they must have put it aside and never looked at it again(which they are very good at).
I'll suggest to send a copy of determination to this email address and explain the situation that you were award by the court but the payment was never made by UKBA.

Hi all friends who support each other on this forum as everyone is pretty much in a same boat. Quick query do we have to send a self addressed special delivery envelope along with application ??? i never sent one does that mean that there will be a further delay
thought the fees will cover it up.

Could you please clear my another doubt that is in page 15, Section 7:
Under the title Personal History there is a statement says,
"It is mandatory to complete section 6A. If it is not complete the application will be invalid and will be returned to the applicant". I can not find section 6A on the application form.
Thank you for correcting the SET(O) form with regards to Question No: 6.3.
There is another confusion, On Page 15 it says
"
Personal history (criminal convictions, war crimes, etc.)
It is mandatory to complete section 6A. If it is not complete the application will be invalid and will be returned to the applicant."
Where as there is no such section n the form. Source:

Hello Team,
Just realised that the latest SET(O) form has duplicate 6.3 question.
6 . 3 What evidence has been provided to support the reasons for all absences from the UK?
6 . 3 When did you last enter the UK?
Many Thanks

Thanks Damanisshallo,
HO has corrected the error in SET(O) Version 12/12(6.3-6.4).
These mistakes are getting more frequent recently.

@Arulsan,
SET(O) page 15, HO meant Section
7, is mandatory. As per at SET(O) version 04/12.
