set m or flr m for my wife

I have applied ilr on ten year long. I want to know when i will get ilr then on which form she has apply for visa set m or flr m. She is here on pbs depandent visa from last three years.[/list]

She can only apply on SET(M) for ILR if she is already on a FLR(M) visa.

I think she can apply SET(O) under other category, when you have received your ILR.

Senior members or gurus can maybe confirm.

In May 2013, she needs to apply on SET(O) and select 'other category'

If you search the forum, you will find many posts of people that have applied for ILR and the spouse on PBS dependent does not qualify as yet. Sushdehta or Lucapooka I think have posted the link to the rules in the last month.

I will try and find it and copy it here for you later.

and this from the guidance (not sure how it affects dependent if you applied under 10 year residence) :

3.2 Dependant of a Points Based System Migrant
Changes were made to the requirements for Points Based System dependents
under the Rules that came into force on 9 July 2012 and 6 September 2012.
These allow a PBS dependent to qualify for leave to remain or indefinite leave
to remain where the PBS migrant is applying for settlement, has become
settled on that basis, or is a British citizen following ILR as a PBS migrant.
Where a person was originally granted leave as:
- The partner of that PBS migrant, or
- The partner of that person when he or she had leave under another
category of the Rules
under the Rules that were in place before 9 July 2012, the period of
continuous residence prior to settlement is 2 years.
In other cases the continuous residence period is 5 years. Further guidance
on this requirement is in the guidance on PBS dependents.
