I have got another question: how strict are past earning requirements?
I am in the UK and since April 2003 I earned 39941 pounds.
Can this income be enough to gain 25 points?

IMHO, you should be ok to claim the points - though it depends on the case-workers 'mood' that day.

BTW, havent you got any expenses claim - during the previous year to make up for the shortfall of GBP 59??

My last year's income was partly because I sell some shares, not my salary. Does it make any difference?
I can sell some shares now to overcome £40K threshold.
Will it be enough?

Shares dont count towards your income as far as HSMP is concerned.

It has got to be income earned from your occupation - not share dealing

I am pretty sure that such a small shortfall could be ignored so long as your proof of that amount is rock-solid (ie no other doubts of whether it might be a lot smaller). I suggest to call HSMP team to confirm or deny that.
