You can apply now as you have been resident for 3 years and are married to a BC.

Because she has been approved for citizenship and is now a BC, you can apply as spouse of BC.

You can apply once she has her certificate of naturalisation which she will get at the ceremony.

1.33 You write where your wife was born - town and country

1.34 You write nationality - British and the relevant details which will be on her certificate when she receives it at the cereomy - because you are applying for naturalisation AFTER her ceremony.

Hi CR001: mabamba and his wife (main applicant) both had granted ILR. And after ILR both granted as setteled person criteria. So why mabamba need tie up with his wife ( I mean main applicant). why he can not apply for naturalization by himseslf any time after one year. Are they till now tied up as main and dependant even after both ILR.

Sorry if this a doom question. I do not know about law/ process about naturalization.

He is not tied to his wife even with ILR. The main + dependent is no longer an issue.

He can apply for naturalisation in two ways :

5 years legal residence - absence max of 450 days and max 90 days in last 12 months
3 years legal residence as spouse of BC - absence max of 270 days and max 90 days in last 12 months.

As the OP has not said how long he has been in the UK, I gave him advice on applying under the spouse of BC, 3 year residence requirement. If he has been resident for 5 years, he can apply based on meeting the 5 year residence requirements.

He can apply at anytime under whichever qualifying period he meets, he is not tied to his wife indefinitely.

For example, I recently apply as spouse of BC with 3 years residence, but my husband and I are separated for over a year but we are still legally married. My BC application was approved but I am not tied to him in any terms of immigration any more.

Thanks

I was Tier 1 main applicant and my misses was my dependent. However I and my misses both got ILR this year 14th November. Now could she not apply for naturalization herself after 14 Nov 2013 independently.
Thanks

Yes, she can apply independently if she meets the relevant residence and absence requirements. The only benefit of a joint application would be a slightly reduced fee but for naturalisation there is no main and dependent category, each person has to complete their own AN form and meet the requirements individually.

If your passport does not cover the last 3 years then show some evidence that you were present in the UK i.e. wage slips or bank statements etc...

You need to supply 5 years addresses this includes both in the UK and abroad.

___________

I lost a passport that covered two years. I have all the p60's/p45's and letters from Inland Revenue. Are they enough to show I was in the country and didn't leave for a period of over 6 months?

I also have all the payslips but I worked over 20hours in some weeks so not sure if its a good idea to send payslips :(

1. Yes.

2. Read the guide (click).

3. You can send copies of your passports if you use a notary public or solicitor to certify them. Make sure you satisfy the conditions including being present in the UK 3 years before the Home Office receive your application.
