ILR and Dependent

Hi,

My Tier-1 (General) visa is about to expire along with my wife visa which is Tier-1 (General) Dependant. I am about to apply the ILR.

Initially I got HSMP visa for 2 years, then after that I got 3 years Tier-1 (General) visa. But, my wife got her visa about three years ago.

I need to confirm whether it is OK to apply for ILR for me and my wife. Here are my details.

HSMP Visa
------------
Valid From: 12-May-2008
UK Entry Date: 26-June-2008
Valid Until: 12-May-2010

Tier-1 (General) Migrant
----------------------------
Valid Until: 12-May-2013


Wife Tier-1 (General) Dependant
--------------------------------------
Valid Until: 16-May-2010
UK Entry Date: 7-July-2010
Valid Until: 12-May-2013

Also, can you tell me which forms are required

Can you tell me is it OK for me to apply for ILR using SET O form.

For the wife, what form do I have to use or is it the same form.

Also, how early can I apply for the ILR.

1) Yes.
2) It's the same form, fill in the sections applicable to dependants. Reading the SET(O) form and associated guidance will be a good starting point.
3) Upto 28 days before 12-May-2013.

2.) Is it necessary to take Life in the UK test before submitting the form.

You and your wife need to take Life in the Uk test (Liuk) at least a few weeks before your ILR application. You can take it now, and it is valid indefinitely. Read Liuk section at UKBA website and also in this forum for how to go about it. You ILR application needs to include original Liuk pass certificate.

You can apply for ILR by post or by attending an appointment at one of the PEOs. Decision on a postal application can take upwards of 6 months. PEO decisions are same day unless some issue arises. You can book PEO appointment only up to 6 weeks in advance of your intended PEO appointment date.

If you begin preparing for Liuk now, and also start with your documents gathering/organising process now, by mid April you should be ready for ILR application.
