That's truly shocking....3 years of waiting. You do get the impression that the UKBA is not staffed by humans but robots.

Can I ask on what grounds you were refused in the previous applications?

Wishing you all the best. [/quote]

Like I said the reasons for refusal were a total farce
After submitting all documents of marriage, they stated that our 14 year marriage was not subsisting
When we challenged that in front of the judge the Eco happily concluded that he had no argument but when we applied afresh because we had to justify the second reason of refusal , our application was rejected again stating again that our marraige was not "subsisting"
Of course our second application had a reference of the first application
Just shows what kind of donkeys are sitting there

I will b so glad when this is over
I don't mean to dishearten any1 but guys I pray that u don't have the bad luck I had and Plz pray that this gets over soon for us

Do you think I should give ait a call or is it soon cos march 19 is the deadline given and who else can I contact/email for an update
Kindly send email / number

I would say that you gave had real bad luck I can't beilieve that they think 14 years is not enough to show you are married. May I ask whee did you two live before you came to the uk 3 years back.?
Secondly why did you guys not fight your second point of refusal instead of reapplying,
This year has been the worse fur appeal as they haven't even been looked at just going straight to court. You can email them but you will just get a generic answer that we are looking into your case please wait for decision.
Maybe after new year they will look into appeals as there will be less spouse visa to deal with...
Maybe you will get a response quick, anything is possible.
Otherwise I hope you good a good barrister to take court with you to fight your case....
Inshallah everything will happen for the best.

Hi
Thanks for the reply
After coming here in 2010 we lived in Pak and before that we were living in Saudi

Because my first case was handled by a relative he didn't put too much of a consideration in it but that appeal went through a solicitor who is pretty renowned and appears on telly also, so it's not a case of having a good solicitor , more of fate I guess

This time the effort was solely mine and through a "better " solicitor and the docs as u can guess were top rank with papers from the mp and my daughters head teacher attached

That's y I implore u guys please pray that this issue can settle soon after the hols even though they have given a deadline in march

What do u mean when u say the tribunal are seven weeks behind

Are they behind in sending ur docs to the Eco or are the Eco are behind

Can u kindly tell me where u got this info from
Thanks

I know about AIT being behind as they told me... When j called.
And ECO are not behind they just haven't looked into any appeal cases since the 9th of July new rules came in due to being short staffed for all the extra visa' s that had been applied for...
If I am honest I notice people on this forum hear a little positive or negative then they hold it too their heart... In reality no one knows what the ECO are doing.... Maybe you should just stick to march as your deadline and if it happens before then that will be the most fantastic thing for you both, and if it doesn't happen then you wee expecting to wait till march....
You may think I'm harsh but it's true. I have never bothered coming on here saying much about my appeal, it's all in Allah's will so what will happen, will happen. Our time come will always come when Allah chooses it to happen.... Just pray for yourself... And I will pray too Allah will always listen.

Meena,

Firstly I'm sorry to hear about the suffering you've had to go through. Hope it turns out for the better.

I don't understand why it's taken 3 years for 2 applications to get this far, based on the info provided, if they reject a 2nd application which goes as far as court, I'd expect it to be closer to 2 years.

Also paying money for solicitors is not all what it seems, these solicitors are more interested in making money than helping the customer. I'm sure the TV lawyer charged an obscene amount of money, made things looks worse than they are and at the end of it offer more of his/her services for your money. Often it's best to do the research yourself and prepare your case yourself as no one knows your situation better than you do.

Hi,

You are right it shouldn't have taken three years.I applied in mid of 2010 with 3 months wage slips but with the delays in their replies due to :the holidays, the jubilee, the rule changes, them lagging behind with the surge of application all led to an decidions which for example should have come in 3 months actually arrived in 7. And they too not the ones I had anticipated.

My timescale
Refusal17/9/12
Sent appeal 8/10/12
Letter of acknowledgement 31/10/12
Decision by 13/3/13

May Almighty make it successful for all

Ps what is Rfc

Alhamdulillah, Visa has been granted.

I would like to thank everyone for their help, especially BatleyKhan.

04/07/12 - Application
10/12/12 - Visa granted

FYi - I submitted all docs in Batley Khans list except for an Housing inspection report.
- Went to collect the wife, and only 3 or 4 basic questions asked when arriving back in the UK.

Yes they can... I believe you need to show savings maybe aswell and also have £120 or so a week after all expenditure have been taken out.....
I know one girl got refused on her money situation... It is in the appeal thread... About a month or two ago... Might be worth looking at.
