ILR Dependent bit complicated. Seniors please guide

Post by arajkumar82 » Mon Dec 24, 2012 7:26 pm

Hi,

Currently i am on tier1 general and my current visa is going to expire in Jan 2013. and I am eligible for ILR in April 2013. I have already applied for another extension as i am short of days for ILR as i came to UK after 90 days of initial grant of entry clearance.

My daughter is currently in India and was born in India. her visa is going to expire in Jan 2013 same as me.

we are planning to bring her in to UK in June 2013 after we got the ILR.

Could you please guide me what is the best way to get ILR for her?

Will she , eligible for ILR after we got the ILR ?

Thanks
Raj

A child may qualify for leave to enter with a view to settlement through qualifying to accompany or join a parent or parents (but not a relative) who has / have been granted limited leave to enter or remain with a view to settlement.

Read SET7.13 How do Children of parents(s) being admitted with a view to settlement in the United Kingdom qualify?

Thanks Damanisshallo.

Please correct me if my understanding is not right.

the child will get limited leave to remain with a view of settlement (ILR) even though child's parents are holding ILR?

if it is how many years the child will receive limited leave to remain/enter?

Thanks
Raj

If both parents hold ILR, then child should get ILE.
However, if a parent has limited leave, then child's leave may be in line with the parent's limited leave.

Thanks Vinny. that clears many of my queries. now i can have peace of mind.

Once we (me and my wife) got the ILR , I can apply ILE for my daughter.

if you could point me the location in this site if anyone has already applied for visa in this category and the documents to submit ,application form type. that would really helpful.

thanks a lot.

So does that mean that if both parents have ILR they can apply for the child's ILE and they do not have to meet the financial requirement.

Only requirement to meet is accomodation. Am I right here ???
