More than 180 days absence in total 5 years time

Dear Members,

Can anybody please share if he/she or his /her friend is on Tier 1 general visa and have got the ILR even if he or she is having more than 180 days absence in total 5 years time according to the new rules applicable after the 11th Dec 12.

Thanks for starting this thread. I wanted to start one myself. My case is also similar. I have spent 1 yr (WP) and 4 Yrs (Tier 1 General). I have total of 187 days absences outside the country in last 5 yrs.

On WP absences - 10 days
On Tier 1 absences - 177 days
Out of these 177 days, 80 days are paid in Uk and remaining worked at offshore. Problem is I cant get an employer letter stating the same.

So I am desperately trying to look for answers in this forum for people who are on Tier 1, have had more than 180 days in last 5 yrs absences and still got ILR. Want to know if they applied with /without the letter from employer.

Hope someone will share their experience.

you are much appreciated for starting this thread and I request all Tier1G members to post their information/experience here who have more than 180 days absences in 5 years so that we can benefit from them. I personally have 210 days absences which are combination of pain and unpaid annual leaves.

Hi People,

I just want to clarify regarding the continuous period for ILR although not 100% sure.

Just think logically, previous rules says 180 days in total of 5 years and now how it can be 180 days in each year i.e 180*5 = 900 days out of UK in total of 5 years. How lienent can HO be from 180 days staright to 900 days.

I am on th same boat as you guys are, out of Uk for more than 180 days in tier 1 G, and eligible to apply for ILR as per new rules not old rules, so thinking either wait for another rule or agree with 180 days per year which I doubt the case is.

Can someone please throw some more light on this?

Its seems odd to me, as anybody can be out of UK for up to 450 days in 5 year time, and up to 90 in last year to apply for BC.
I never heard about 180 days per year. its 180 days during 5 years.
I may be wrong, as Im not expert.

This is incorrect. There have been recent rule changes effective Dec 13th, 2012 which affect the number of absences allowed. It would be worth having a read through the latest guidance and immigration rules to understand what they are, if you intend on applying in the near future.

He told I need to provide medical certificate if more than 90 days .But today i have discussed with whiterose they said no need of medical certificate

I am not sure if your doubts are clarified yet. Your case seems similar to mine
WP: Mar 2007-Apr2008
Tier-1: May-2008-Mar2012
I switched to ILR in Apr 2012
I had a total absence of 208 days (from Mar 2007 till Mar 2012)
I was sent back to my base location by my employer from Apr 2009 till end of Jul 2009 and wasn't paid in UK for this duration. I did make a trip for a week so that I did not cross the continuous absence of 90 days(this rule is no more in place after Dec 2012 rule changes). However, even after having total absence of 208 days I was gtanted ILR at PEO Solihul without any questions asked about my extra absence. You may read my PEO experience here:

Many Thanks for your reply. It really helps. From the posts I have seen so far, it looks like for Tier 1 case, we dont need to provide any proof and there can be absences up to 180 days in a year (not 180 days in 5 years as I was fearing before)

Now I need to just pray God that caseworker does not ask for things that are not required.

Would appreciate if you could let us know when you got ILR. Did you use the New application form or the old version?
