Because those were the rules when the MBA provision was set. It is only good for the initial application. Surely, you don't think you can keep on getting extensions by just showing the MBA certificate? This quote relates to some exceptional cases where a higher points were granted in a previous application due to differences in the educational level (for example a Master degree in a foreign country that is recognised as Phd level for the application). I don't think you have any legal ground here just because of the wording in the guide.If this is the case then, the UKBA would not have mentioned this exception in the guideline, that the applicant may claim the higher points score as in the previous assessment. Surely this point will hold up legally?
