When can non eu spouse of eea national apply for passport?

Post by Premo » Sun Jan 13, 2013 12:48 pm

Hi there,

I'm a EU national and married to my wife from the Caribbean. She has an EEA2 family permit which will expire in 2 years time. I have a few questions.

- How early can she do the immigration test? She's already 3 years on her EEA2 permit. Can she do it now? Will it cost her money?

- Can she apply for British nationality after her 5 years are up and having her automatic permanent residence? If so, how much time does UKBA gives you to apply for the passport?

- are there any new changes in regulations with regards to non EU spouses who want to apply for passport?

Many thanks for your help!

Thank you Jambo! Really helpful.

Another question: after 5 yrs when she automatically gets PR, how can she obtain a PR visa in her passport (so that she can travel etcetera) before applying for BC-ship?

At the moment she has a 5 yrs residence visa in her passport.

Thanks

Ah yes thank you. I found the EEA4 form on the UKBA website.

There is no fee involved as far as i can see. Is this correct?

Thank you!

One more thing:

- How early can she do the immigration test? She's already 3 years on her EEA2 permit. Can she do it now? Will it cost her money?

She doesn't. She only does the Life in the UK test before applying for citizenship. Unlike others, EEA nationals and their family members receive permanent residence status, not ILR. No test is needed. After 1 year on that status, she can apply for naturalization and then she must take the test.
