ilr dependant visa acceptable absences!!

Hello,
My wife is on ilr spouse/dependant visa under the old rule......
visa issued 13/08/12
visa expeiring 13/11/14
entered uk 07 nov 2012.....

We are currently planning on a 4 week holiday in oct, so was wondering if this absence will have adverse effect on her appling for ilr after 23months, 07sep2014.

HI crb,

The absence wont be an issue in case of your wife's ILR.

However, she would be eligible to apply on 7 nov 14 rather than earlier as she needs to complete two years of living in the UK and you need the proofs of the same.

I could be wrong but that's my understanding!

also are you sure old rules apply in your case as after July 12 the dependant needs to stay for 5 yrs instead of 2?

I am not 100% sure, but I do believe that the people issued with old visas are still treated under the old rule.....so their ilr eligibelity is still 2 yrs and will still be considered under the old requirements...my wife's application date was end of JUNE 2012,
