Qualifying period for ILR (Dependent)Main applicant pointbas

Hi Folks,
My spouse was granted visa last November and their visa expires this January as mine. I have just been granted ILR I was told by a solicitor that they should be qualified for ILR since I am point-based. That is to say my dependent have not stayed up to 2 years as popularly known, they have just been here for two months!

Has anyone had a similar experience?

Ask that solicitor to re-read Immigration Rule 319E.

Thanks for your reply. I was able to get through to UKBA and they said since I was here on a point based arrangement before the rules changed sometime in 2008-they qualify for ILR.
I don't know if there is anyone out there who have applied through such arrangement and got it.....

Thanks for your response. My spouse has been here since 12th November, 2012 and permit expires 19th Jan 2013. They were granted visa around 9/11/2012....

Hello
My spouse actually got the said ILR. We picked up the courage to give it a try. Then applied for a PEO appointment and put the necessary documentation and the ILR was awarded the same day.

How did your wife manage to get ILR with only being in the UK for 2 months? Isn't the requirement is for 2 years? I hope you could please clarify. Thank you.

I was here on a WP before the Tier system. spouse had immediate grant of ILR then. Therefore, because I was here before the rules changed, my spouse was automatically qualified to receive ILR at the same time as me, even though they have just been granted Leave to Remain for less than 2 months.

Can you please confirm more details about your case:

- Did you applied together for ILR
- Do you know what are the rules before Tier system.

I am on WP prior to Tier1, my spouse was on her own WP & Tier1 visa before she got her Tier1 dependent visa in Apr 2012 and we are staying together in UK sinace Mar 2008 (except for 10 months - Jun 2011 - May 2012).

Do you think, will that rules before Tier system apply to us as well?

Thanks Veera,
I applied a few weeks before my spouse (not for any reason though, except all their documents were not ready )
My WP was point based but before the tier system
Before the tier system, I think spouses were not giving the current qualifying period of 2 years-hence our qualification.

I hope the info is enough for your application. However, you can call UKBA on their 0870...number and enquire from them if you are qualified/eligible to apply. I did and was glad with the info they gave. It could be daunting putting the call through though.
