ILR - Eligibility

Hi,

I need a clarification on my ILR eligibility date:-

I was granted VISA on 08/Jul/08 and I entered the UK on 10/AUg/08.
Could anyone please confirm if I am eligible to apply ILR 28days before VISA granted date or 28days before I entered the UK.

The qualifying period will always be counted from the date of entry clearance (08/jul/08).

Hi Mohit,
The visa start date mentioned in your tier-2 visa document would be applicable which is 08-jul-08. Also BTW I also came during same time and i guess the CoS Tier2 scheme was not started then.
So did you came on Work Permit or Work Permit (TWES)?
I'm asking coz it was WP(TWES ) in my case so not sure of applying for ILR jul this year.

I understand your dilemma now, mohit. I am facing the same scenario where if I apply 28 days before my entry clearance, my work visa would expire. (as i entered the country 35 days after visa was issued)

I AM ASSUMING YOU HAVE A SINGLE 5 YRS CONTINOUS VISA (like me)

I am seeking response from Moderators/experts to my query on General visa section of this forum.

However I think the link I have sent below, explains that as long as this gap is not 90 days, it (the gap) would be counted towards your 5 yrs continous period for ILR which I now assumes that (In your and my case):
1) we would be able to apply 28 days before VISA ISSUE DATE

OR

2) we allowed to overstay just to meet 28 days criterion.

not sure which one of the option is correct.
