Hi Friendz,
I initially came to UK in WP and then shifted to HSMP and then to Tier-1
Could you suggest if i could apply for ILR with the below gaps please

I have still not applied for ILR as per Pre-Dec 13 rules; i wont be eligible as i have break for more then 90 days. I guess post-Dec rules i am eligible ?

Hi Girish,
Your case seems to be OK as per the new rule, Not a problem

If you don't > 180 days absence in 12 months time, that is not problem

Hi Girish,

The specified continuous period is counted backwards from the date of the ILR application. For example, if the date of application is 11 November 2012, the consecutive periods would be as follows:
Year 1
11 November 2012 to 10 November 2011
Year 2
11 November 2011 to 10 November 2010
Year 3
11 November 2010 to 10 November 2009
Year 4
11 November 2009 to 10 November 2008
Year 5
11 November 2008 to 10 November 2007

Hence calculate the same for your case.

Read guidance notes, it's specified clearly in there.
I have my ILR since march 2013, previously based on HSMP+Tier1 ext. All views are my own, am not a professional on immigration matters.
