Calculating continuous period of 5 years

Post by sudeepforu » Mon Jan 28, 2013 11:26 pm

Hi Guys,

I have been going through the document for calculating 5 years continuous period. This has been revised on December 13, 2012 and again revised on Jan 23rd 2013 with no changes made.

http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

Now my question is whether I am eligible to apply for ILR.
I initially came to UK on HSMP (stamped on 1st March 2008, entered UK on 4th April 2008) . I got an extension on Tier-1 General which is valid until 8th March 2013.
I have spent less than 180 days outside UK during this time.

I have my appointment on Feb 8th 2013

Going by basic calculations of 1st march 2008 (stamped date) and applying 28 days before 5 years , 8th Feb 2013, it looks like I am eligible.

But what surprised me was the continuous period calculation as specified in the document.

On Page 9, It considers an example where they calculate 5 years continuous period. But it starts calculating 5 years backwards from the date of application, not the date of visa expiry.

Obviously I wouldn't even complete 5 years if they use 8th feb to calculate backwards as my visa was stamped on march 1st 2008.

Does that mean I don't qualify?

Thank you for reading this lengthy post and hopefully someone can provide some insight as to what I have missed.
