Hi All,

I need a bit of information about T1 Gen. Ext. My T1 Gen Visa is expiring on 3rd March 2013 and I have got PEO appointment for 1st of Feb 2013. I just want to know if that's going be problem for me when I apply for ILR in future because as of 1st Feb 2013 I will be out of 28 days window. (Just by 3 days)

Any help and information are much appreciated

Not sure --- I phoned UKBA re the same question, and they said you should never apply more than 28 days in advance...

Maybe call them - if you do - please post back what they say.

What do you mean by "will be out of 28 days window. (Just by 3 days)"? You haven't mentioned your entry or EC dates to understand when you would qualify for ILR to comment.

I got initiall visa on 3rd of March 2010 for 3 years and due for extenstion for further 2 years to make it total 5 years. I am due for ILR in March 2015 under 5 years rule

Out of 28 days window means I should apply after 3rd Feb but I have got an appointment for 1st Feb.

If you entered the UK within 3 months of EC or your T1G application was made in-country, you would be eligible to apply for ILR from upto 28 days before the 5th anniversary from 3rd of March 2010. I.e. http://www.timeanddate.com/date/dateadd ... &ad=28&aw=

Note that this is the earliest date you would be eligible to apply, so your T1G extension must cover the above date. And to give you more of a buffer for your ILR application date, your T1G leave should ideally cover a couple more weeks. The ideal case would be that you are granted leave to cover the entire 5 years residence.

Yes that what I though as well and that why I mentioned in my post that I should apply either on or after 3rd feb 2013 for extention.

What are the suggesstions? Should I go for extention on 1st or book an other appointment.

I would book an appointment for on or after the 3rd to ensure that your LTR extension grant covers the required residence period.

what do you mean they are "not that bad"?

There is a 28 days rule in place, CW have to apply in his case. OP of course can rely on being at merci of the CW which would cosider his 3 days early ILR application and would make an exception. But, this is unlikely to happen.
I suggest OP not to risk and re-book the appointment, i fyou cant find the dates yourself spend pennies and go for solicitor appointment or postal (if you dare to wait for half a year ).

Hi sorry I forget to mention that I came to UK in Oct 2003. So I can apply under 10 years rule as well. I don't think there should be any problem.

Any idea??

My suggestion would be to first look at your entire residence period in the UK. Then understand the category or catogeries that you would be eligible to apply under. Determine which one you want to apply under after this. Do also note that long residence applications cannot be made in-person @ a PEO, therefore must be made by post.

Rules/Guidance/Requirements for long residence are different to those for economic migrants.

Guys Thanks for all suggestion.. We got our visa yesterday.. no hiccups. Now next stage is ILR under 10 years rules. please share any experience about ILR under 10 years. A brief summary is below:

Entry Clearance as student : 2nd sept 2003
Arrived in UK: 5th Oct 2003

Always in time applications.

Due for ILR after 7th Sep 2013 under 10 year rule. Right??

Dependents:
Wife Came to UK in Oct 2009 on dependent visa and still my dependent
Son Born in UK in Feb 2011 and he is also on dependent visa

Could senior members advise what should I do for my wife and son and what r any other options available for me..

Also I have to do life in the UK test. Should my wife do the same or ESOL with citizenship content.

Hi M S Vayani..... Congruatulations on getting ur visa... it's really great feeling when you receive.. I am also due to apply for extension in March 2013 and have a dependent wife visa extension and to apply for dependent visa for baby born in UK.

Could you please share the list of documents that you submitted for your application.
