LTR via Green Card & Naturalisation

Post by MissTraveller » Thu Jan 24, 2013 3:27 pm

If supposedly I had a job in Ireland and was issued a green card. After two years, I had to renew it. But if I am only renewing it then I do not qualify for LTR. Instead I should get a Stamp 4 which will be valid for three years. Therefore, after completion of 5 years, I will be eligible for LTR. Is my understanding correct?

What happens after LTR? Is this a route to naturalisation / getting citizenship?

I think you're on the right track. After you get your LTR you can then apply for Naturalisation which the decision may be quicker than others.

You could also apply for Naturalisation immediately after your 5 years is complete without the need of applying for LTR.

When the Green Card scheme was introduced, it was envisaged that the Immigration and Residence Bill would be enacted shortly afterwards. The Bill made provision for Long Term Residence (5 years I think?) for Green Card holders after (I think) 2 years. The Bill was never enacted and later scrapped and re-written. I am not sure if the latest version contains the LTR provision. In any event, the Minister/GNIB decided to grant Stamp 4 to Green Card holders after 2 years, for a period of one and then two years, in a temporary scheme until enactment of the new legislation. They seem to be still doing that. Former Green Card holders can then apply for naturalisation after five years on Stamp 1, 3 or 4. So there is no scheme for "Long Term Residence" for Green Card holders at present.

LTR via Green Card

Post by exam » Sat Feb 02, 2013 1:27 pm

Hi All:

I am on the same track, I had my green card for 2 years, then given stamp 4 for 1 and then stamp 4 again for another 2 years, so total 5 years.

My question is, can I apply for LTR? Because I am getting confused with the following statement, that applicants falling under this category can not apply for LTR:

"The applicant holds only Green Card (Employment) permits. Once the Immigration, Residence and Protection Bill 2008 has been enacted, Green Card (Employment) Permit holders will be eligible to make direct application to the Minister for Justice and Equality for consideration for Long Term Residency."

The link for this is: http://www.inis.gov.ie/en/INIS/Pages/Lo ... _Residency

Does it mean that only those can't apply for LTR who hold Green Card for 2 years?

Many thanks if you guys could comment.

Exam.

No you are not eligible for the LTR scheme as currently stands. You can of course apply for naturalisation.

I called the LTR department and answer was YES.

YES if you completed 5 years, including green card and the stamp 4s which u get after your green card is expired or finished.

Sounds like a bad advice from ImmigrationLawyer
