WP->HSMP Dependent -> HSMP

Post by tomkin » Tue Feb 27, 2007 2:00 pm

What are the implications of going through WP->HSMP Dependent -> HSMP

Will the ILR clock be reset or is it not allowed ?

True, but I am not sure if you can switch from HSMP dependent to HSMP while in the country. I am not saying no, but just make sure if the switching is possible in-country.

Yes, it is true that you will not be allowed to switch from "HSMP Dependent" to "HSMP main" within the UK. You'll need to return to your home country and apply for an EC at such time.

Also, the time you spend as HSMP Dependent is not counted towards ILR. So when you return to UK after an EC on basis of HSMP in your own right, your ILR count will start all over again (5 years from then, provided HO doesn't change the timelines again  ).

Thanks for all the replies and clarificatrion

Now if someone is on WP and there are still 2years 5 months for PR. Does applying for HSMP (approved) guarantee PR, if FLR(hsmp) is applied exactly 2 years before FLR, assuming the laws wont change.

Couldn't understand what you are trying to ask :( ! Can you rephrase or be more clear ?

From what liitle I understood, let me reply ..

If X is the time duration you spend in UK on WP and Y is the time duration you need to spend on HSMP (main). In this case,
1) as long as Y immediately follows X (if there is a break, it should be within permissible limits only), and
2) X+Y = 5 years
then you will be eligible for PR after spending Y years on HSMP (main) visa !!

Does this answer your query ?

UkJobsForMe,

You got it exactly right. :)

1. WP = 2 years and 5 months (at the moment)
2. Apply for HSMP in say April
3. Will get the approval in May
4. Apply for FLR (HSMP) when exact 2 years are left for PR

I assume PR is guaranteed and whil on FLR (HSMP) do not need to worry about maintaining earnings and other qualification criterion associated with HSMP. I would like to call is pseudo-PR :)

When you apply for PR using the SET(XYZ) form(s) as and when the time comes, you'll still need to show evidence of earnings and accommodation. But yes, you will not need to meet the HSMP criteria of scoring 75 points !!

But and more importantly, make sure you get your initial FLR(HSMP) stamped at such time that you become eligible for PR before your FLR(HSMP) is due for extension.

As long as the HO doesn't change any related laws till then, I thing you'll be safe :)

I was under the impression when you move from HSMP to WP or vice-versa the ILR clock was reset?
I just moved from HSMP (after one year) to WP and I was told to slog all over again for five years.

You were Cheated :)

Clock is reset when you move from HSMP->WP not vice versa.
