Running short of 10 days for applying ILR

Running short of 10 days for applying ILR

I came to UK on WP 2nd April, 2008 , wP was granted12march.
Then switched to tier 1 on 3 rd feb 2010 valid till 3rd feb 2013. So falling literally short of 10 days to ILR

Question is should I extend or is there a way to apply for ILR??


Please if someone could help me

You can apply 28 days before the end of your five year residence period; does that help your predicament? Because you switched category from WP to T1 you are not entitled use the 3 month late entry concession.

Yes I am wondering about the 28 day rule the only problem I see is my five years complete on 12 march but my visa runs out on 3 rd feb and if I apply the 28 day rule I should be applying for ILR on 12 th feb whereas my visa expires 3 feb , so just running short of 9 days:(. Am soo confused as to why I should apply for extention for only 9 days. Has anyone ever come across this issue and been able to work it out , if there is. Possibility I can irectl make only one application for ILR?

Under current directions, you should apply for an extension before your leave expires. However, if they haven't decided by the time you are eligible for ILR, then you may vary your application to ILR.
