Pls. edvise on earliest date to apply for ILR

Hi,

I came to UK on 16th Apr 2008 as WP (EC date 10th Apr 2008)
Switched to T1G in May 2009 and then extended T1G until Sep 2013.

Can you please advise what is the earliest date I can apply for ILR.

I'm a bit confused by the rules cos they say I can apply 28 days before 5th anniversary if my visa expires before 5th anniversary. But my visa will be still valid till Sep 2013.

In most cases, you need to complete 5 years in UK in qualifying categories.

You can apply during the last 28 days of the fifth year.

You should ideally have valid visa at time of application.

Stick to these three rules, you will be fine.

The fact that you have extant LTR until Sep 2013, does not affect the earliest date you are eligible to apply for ILR. You can always delay applying (but apply before your current LTR expiry date) if you wish to do so.
