I am really confused about what English test needs to be taken by husband to join me in the uk forever. Is ielts ok?

You would be covered by S3C/D during your appeal if your initial application was made in-time, prior to your former visa expiry date. Meaning you would now have the same immigration status as you did prior to your visa expiry. So the question is, what visa did you have? Was it a Tier 1 General visa?

OP, in response to your subsequent PM, the question raised here is not about your husband's immigration status; it's about your current immigration status. What is your current immigration status in the UK?
