Refused boarding non eu spouse without schengan visa

I am Indian national. And my wife is from Czech Republic.. I have five year UK resident card as a family member of eea.. Today I was refused to get entry in Belgium because they said there is expiry date on my residence card which is Nov 2017..According. To eu union law.. I can travel with my wife to Europe... I don't know why the refused me on the port. We are going for 5 days holidays. By ferry from Hull to zeebrugges... I have spent 300 pound on tickets and they don't want me to return the money.. They give me two days to sort out and said to me that you have to apply. For schengan visa.. ... Do I need visa or not... Please advise what to do now..

Were you trying to board together with your wife? Who did deny boarding? The ferry company?

If travelling together with your wife, you don't need a visa. The RC is enough.

we were travelling together..they let us in first but during the check in time she called us back and told me that we recieved the call from brussels and they said you have expiry date on your residence card which is nov 2017...so they cant let me travel to belgium...i think the ferry companmy just make excuse because she keep repeating we have to pay £2000 pound as a fine ...according to eu union law i can travel with my wife to schenegen area...i dnt know whats going on...can i compaliant against ferry comapany...i am going to consult belgium embassy today..if they told me you dont need visa i am going to sue ferry company...can u advise what i have to do?

See similar story (different carrier and different destination but similar rules apply) - Refused boarding for non-eu spouse without Schengen.

Try to get the reason for refusal in writing.

(also - I suggest you edit the subject line of the first post - "please help" doesn't say much so people might not go and read your posts).

There is an expiry date on most things like passports, visas, residence cards, etc.

my passport expiry date
2019,resident expiry date 2017. I think they want permanent residence card to travel...but according to law you can travel with your wife even u have eea2 family resident card..i dnt know what they upto

Even a permanent residence card has an expiry date.

If you search the Belgian embassy website, you will see advice to the effect that residence card holders can travel visa free.

That is just not right!!! as long as you are travelling with your EEA spouse, you don't need no visa and as long as your expiry date on your RC is not in 6 months or less(apply to passport as well) you are fine.
If this happens to me, I will make sure I get the compensation for the lose and stress. But like Jambo said, it's best to have proof for complaint, so ask them to refuse you by letter not just a verbal. good luck mate.

HO received on 27/02/2012.
Refusal received on 16/08/2012 dated 11/08/2012
At the court, the HO REP withdrawn the decision and asked me to send the DOC for the time before marriage.

Its really strange and sign of ignorance because article 2 of Directive 2004/38/EC very well define the family members and their free entry entitlement.

yes i was in uk...we were going from hull east yorkshire to zeebrugges...they dnt let us go....we r going to claim anyway

i m nt happy as well..people behind the counter does not kow the law..i ll get the refusal letter today from them

YES FOR EVERYONE JUST TO IMAGINE HOW STUPID THEY ARE!! EVEN THOUGH BELGIUM AND AMSTERDAM ARE EU UNION... THEY REFUSED HIM IN BELGIUM BUT ACCEPTED TO AMSTERDAM!!!!!!!!!

yes u need a visa to enter eu unless you travel together with ur wife and make sure u have a marriage certificate with you or apply for a schengen visa to any embassy which is in an agreeament with the schengen visa ....but my advise go with the wife is much easier...i done it many times no issues...
