Tier 2 ICT - 5 years max

Post by WP09 » Tue Apr 26, 2011 4:50 pm

Hi Experts

I'm not able to find similar topic so posting here.

Need clarification on this point which recently changed for ICT for long term visa-
"After five years in the UK the migrant must return overseas for a minimum of 12 months before applying for a tier 2 (ICT) visa again"

I'm currently on Tier 2 ICT visa valid until 2013 jan. I got an extension for 3 years in Jan 2010 (previously I was on work permit). My query is - will they count 5 years from Jan 2010 when I got extension OR will it be counted from April 6, 2011?

Regards

What is your current status? Did you managed to get extension?

Hi, the 5 years will be counted since the day you landed in UK in your first WP. As far as I understand you came he before April 2010 in your WP so as per UKBA you will be eligible for ILR on day of landing in UK + 5 years
