Complaint about the Prospective employer - where and how?

Post by mgmtgraduk » Thu Feb 28, 2013 1:46 pm

Hi,

This is regarding a very bad experience from a prospective employer in terms of his approach, accountability and suspected malpractices.

I was in talks with the sponsor employer for Tier-2 application around when my current student visa was about to be expired after 3 weeks. Since then, he repeatedly confirmed that my application could be processed as soon as I produce my postgrad certificate which I got after a week, leaving the employer about 2 weeks time to decide and letting me know if my application has any problems in processing.

I had already booked ticket to go back to India, which I rescheduled after talking with him as he was going to employ me. I spent around GBP200 for flight rescheduling.
However, just 4 four days before expiring my visa, he confirmed that he can not process my application with a reason that the UKBA rules have changed in June 2012, and under that he cannot meet the salary requirement.
Following this, I had to reschedule the flight for immediate return to India, for which I had to spend additional GBP300.

Thus I had to spend about GBP500 for literally NOTHING!
I tried reach him again seeking a possible compensation from him expecting a moral responsibility from him. However, he rudely denied, and then never answered my call.

The second important point I got to know from him while my application was being processed that he holds four Tier-2 visas, however does not provide salaries to them but gives out only compensation to them. I fairly see his malpractices in his company.

I would like to complain about this to - possibly get some compensation for my expenses, and also scrutinize the company practices from UKBA.

Could someone suggest me please on where and how to complain about this?

Thank you.

for any suspected immigration crime or malpractice, you can report to UKBA using the below link

http://www.ukba.homeoffice.gov.uk/about ... ort-crime/

unless you had any written confirmation from the prospective employer on a potential affirmative decision, it's unlikely you'll get any confirmation. There is no obligation on employers part to take a decision within a specific period unless it was agreed before hand.
