impact of the new soc code update to 2010 from 2000

Post by sadol40 » Tue Mar 05, 2013 7:28 pm

hi guys,
i am currently on tier 2 and looking at the statement , I understood it as when I am due to renew or extend my current permission, the salary for my job which was £2900(37.5 hours) last year should be £7250 above the £29000 thus £36250 ( 25%)?
or is it 25 percentile above the base rate which I do not know how to find it .

my soc code used to be 2132 . under this soc code you had number of jobs each with different salary requirements ranging from £25000 to £45000

Looking at the statement and annex c, I belive my soc code has been changed to either 2136 or 2139 which have the following requirement
2136, new :£24000 exp:£29800
2139, new :£20,300 exp:£28400
Looking at above, it does not show anything about job title or description of duty etc and it is really confusing . I believe I am most liekley under 2139 so does that mean me by earning £29000 are above the experienced rate ?
Or is the above new/exp rate is only the starting point and they will release a more detailed job title and salary requirements for 2139 and 2136 ?

Sorry I am really confused and appreciate all of your inputs.
Finally, are these soc codes due to be reviewed every year thus the requirement may increase again ?

Many thanks

or let me put this question to you guys this way

my soc code was 2132 and it had around 30 job titles under it with different range of salaries from 20k upward to 47k

now as there is no job title etc on the annoncement but only a new soc code which i belive mine is 2139 as I am in networking , does this mean that as long as my job is networking and i earn above the exp rate which is £29800 then i can extend my application and apply for ILR regardless of my job title

in another word, has the job title gone from the soc codes ?

if so is the figure of the exp rate and entry rate updated every year depending on the Annual Survey of Hours and Earnings of the previous year ?

Hey guys, I have sort of similar question. in the statement it says,
"The new criteria will apply to Tier 2 migrants who were already in the route before 6th April (and to work permit holders) if they make extension or change of employment applications relying on Certificates of Sponsorship assigned on or after 6th April, or if they make applications for settlement. The updated salary thresholds and appropriate rates reflect changes in UK earnings and we expect migrant workers’ pay to have risen in line with that of settled workers. However, the new rates will only apply at the point they make their next application, not during any leave they have currently."

I am due to apply for extesion April 2014 (got initial T2 General in July 2011). my current salary is £23k. according to my new SOC code, experienced worker salary is £21,800 p.a.

my questions is:
during my extionsion next year, what salary is appropriate for me? Experienced worker salary of £21,800 or 25% of my current salary (25% of 23k is 5750, so salary during extension to be £28,750)?

would really appreciate if someone could help?

Many thanks

They state : "In all cases, applicants will not be classed as new entrant employees if they are applying to extend their total stay in Tier 2 and/or as a work permit holder beyond 3 years and 1 month (the maximum grant for initial Tier 2 applications)."

and

"Only those who entered Tier 2 (or the work permit arrangements) before 6 April 2011 may be paid below these thresholds, when they apply to extend their stay, change employment, or settle in the UK. However, in most of these cases, the “experienced worker” rate will apply; the “new entrant” rate will only be relevant to those applicants who have been in Tier 2 and/or the work permit arrangements for less than 3 years and 1 month in total when they make their next application."

So if you tier-2 less then 3 years and 1 month so you apply New Entrant to extend.

However I wonder my the salary based on 39 hours, but I only work 37.5 hours/week so I should pro-rate or ....

There was no experienced salary for 2312. So do I use the new entrant?

I think if you are in Tier-2 less then 3 years and 1 month at the point you would like to extend your visa so you can use the entrant otherwise you should apply "Senior lecturer / advanced teacher and equivalent: £32,421
Further education management / principal lecturer and equivalent: £35,304"

I think UKBA will update documents(tier-2 guide and SOC guide....) soon.

Hi guys
I think this applies to everyone who applies after 6 th April 2013 . Ukba have made it clear that employers should not employ migrants if they can't pay migrants experienced worker wages. If you are due for extension get a cos before April 6 th and apply ASAP.
It's getting tougher by the day.

The way they're doing it is so ridiculous!!! You get a visa and think it's all okay now for 6 years! whats th 25 percentile then if you are extending?

New SOC Code will apply on you. IF you have worked over a year then you will be considered as Experience one.

Hi Muhdkhokhar,

What is the case for 2312 Further education lecturer? I don't think I will earn 32K in 3 years. What would be my other options?

Thanks

So, What would be the solution to the problem? :(

I know I have 3 years before I apply for extension but I really want to plan now so that worse come to worst I can apply for Masters so I can qualify for 10 years :(

Hi muhdkhokhar & tuanvo1982 Many Thanks for your reply. I can finally have some peace. I read the statement of intent and MAC pdf's but couldn't find any line which states about the psw to tier 2 criteria (even though there is a line which states on psw to Entrepreneur). I have been working for the past 4 months in my current job and I have 4 months internship experience. Will my internship experience also count or is it just to do with my current job ? Please help.
