Reducing working time and keep salary when Extending Tier-2

Post by tuanvo1982 » Fri Mar 08, 2013 9:43 am

My sponsor accept to reduce working time and keep salary when extending Tier-2 but I don't know it is legal for UKBA to accept my extension application.

Now it is 37.5 and in my next application I would like to make it 35 hours with the same salary. Any idea would be welcome.

Thank very much

Read para 213 of the Tier 2 (general) policy guidance.

213. Some employers are temporarily reducing workers’ hours to avoid making redundancies.
A change of employment application is not required if:
• you currently have leave as a work permit holder or under Tier 2; and
• you are continuing to work in the same job, with reduced working hours; and
• the reduced working hours are part of a company-wide policy to avoid redundancies;
and
• your employer is not treating Tier 2 skilled workers more favourably than resident
workers; and
• any reduction in your wages is proportionate to the reduction in your hours and is not
reduced by more than 30%; and
• the arrangements will be in place for no more than one year.

Thank you very much but I mean when I extend my visa not for current leave. The guide is for current leave.

In order to extend your leave you must have met the conditions of your existing leave throughout its duration. These are (some of) the conditions. If your situation falls within the description above you should be fine.
