Switching from Tier 1 general to Tier 2 general. help please

Post by patelmilanb1 » Thu Feb 21, 2013 10:01 am

Hi All,

I am seeking expert advice on this. Here are status on my visa.

Currently i am on Tier -1 general Visa which is expiring on 14/06/2013.
=============

First Entry in UK - Tier 4 Dependent -
08/01/2010, Expired on 30/03/2011

Extended Tier - 4 Dependent -
14/02/2011, Expired on 30/09/2013

In between

Switched Form Tier 4 Dependent to Tier -1 General Main applicant -
14/06/2011 , Expires on 14/06/2013

No i have a extension coming in 14th June. I do meet the salary criteria which is 40k as of now, so my company is willing to sponsor me Tier -2 visa.

My question is if i transfer my visa from Tier -1 general to Tier -2 general now, is it goona reset my ILR period of 5 years.

As you can see from my visa dates, I will complete my 5 years including Tier -1 general 2 years and lets say I transfer to Tier -2 now and i spend 3 years more , will i be eligible after 3 years for my ILR or I will have to spend 5 years on my Tier -2 to get my ILR.

please advice as my time is running out.

the main reason of thinking to tier 2 from tier -1 is that i am short of 13k by the end of JUN to be eligible for Tier- 1 extension. I am also thinking of self employed option BUT i need to get clear view on Tier- 2 process.

Thanks in advance.

Hi,
I have similar situation to you.
first entry on Tier 2 (nov-2008 to march 2010). = 1 yr 4 months
switched to Tier 1 (march 2010 - march 2013) 3 yrs.
now planning to switch to Tier 2 again. application is filed for 5 years again.
If I get my Tier 2 approval now from (April 2013) am I still be eligible to apply for ILR after November 2013 ? As at this time I will be completing my 5 years stay in UK.

please let me know if you get a response for your query and I will do the same if I get any information regarding this situation.

sorry for any inconvenience.

Thanks & Regards,
Prashanth

Your time spent on tier 1 will count towards ILR. Switching to tier 2 won't reset your clock. Make sure you make a on time valid application before your tier 1 visa expires

Yes you will be eligible to apply for ILR 28 days before the completion of 5 year anniversary in Nov 2013
