Hi Please help me with the replies.

23 June, 2008 Visa granted to come to UK.
20 August I came to UK (entered first time on HSMP).

15 September 2010 - 20 days in home country

17 January 2011- Father Passed away another 10 days abroad.

4 July 2011- Mother passed away 20 days absent.

my current visa will expire on 23 June, 2013.

2 questions.
1. Do I meet the continuous criteria?
Can I apply 28 days prior to the expiry date / when earliest can I apply for ILR?

I have been told by some lawyer that I may not be able to apply before July and my visa will be expired on June 23.

I have studied somewhere that if you land within 90 days you initial period will be counted in the total days out of the country.

Please share your review and guide me please.

obviously the lawyer doesn't know what he is talking.you can apply 28 days before the 5th anniversary of your initial Entry Clearance (Visa Stamping) if you entered the country within 90 days of the grant of your visa.
