Re: Work permission while application is still with HO

Drmahmoodakhtar wrote:HELLO EVERY ONE!

I have lodged an application on FLR (o) form for discretionary leave to remain like 6 months ago...on my last extension my Biometric card's remarks mentioned NO WORK as i was student...for some quite reasons i have switched to FLRo discreationary leave despite of tier4 extension.

My question is that how can i get permission from HO for work as it is more than 6 months now that my application is still with home office and i am unable to work unless i have some documents of work permission. my timeline is:

Application submitted 30/08/2012
Acknowledgement letter 07/09/2012
Biometric letter 14/02/2013
Biometric done 22/02/2013
Docs return waiting

please guide!

i wish good luck to all the applicants
so you were a tier4 general student before? you're allowed to work but its cant be a permanent position. i dont know how they measure that but just get a job and show them that you have applied for FLR if they ask. read this.

automatic public funds is granted to those on discretionary leave. The rules changed in 2012 so the discretionary leave option is not available to those anymore unless you are extending

Hi Athu1,

Until you are granted discretionary leave or any other leave to remain your old visa applies (I.e you are still considered as a tier 4). What it means is that you can still work but will still be required to follow your tier 4 rules (20hrs per week)

if you have finished your course officially you can work full time as you are no longer in term time. so you can work until your visa is granted.

hi my application is fresh. and heres my story, came here on student visa and i was not able to apply for flrm becasue my wife has been suffering from a cyst infection for the past 4 years. she eventually had a final surgery which doctors still say she needs to come for regular check up. so after my course ended officially i had a temporary full time job and she also got a job so when both salaries are combined we exceed 1550 but since my visa was expiring in jan 30 i couldnt take the risk of over staying and i could not meet the 6 months for the flrm i did go to the peo but was told i have to post it so i applied for the 10 year partner route with only 3 months payslips and other documents. so basically thats my story.
I sent documents on the 15th
hom office received on 16t
money taked 17th jan
ack letter received 21st jan dated 17th
then just this 12th march tuesday i called HO sying i have not receivd my bio letter and i was told that they wil lrequest and it will take 15 working days but i received it yester da 15th mach but letter was dated on the 8th. so am a bit confused my self. may b when i get another bio letter ill just call and explain cos i made the call on 12th march recedv letter 16th march but leter was dated 8th march. lol. but am praying and believe my case will be granted..
what about you whats your story

on the flro form there is no d leave to remain any more. but it has all the required documents you will need. section 8 tell it all

Thanks, came UK 2004 on student, overstayed since Nov 2008, met my partner and started living togather with her and her son 13years old since Jan 2010, applied FLRO in July 2011 got refused in Sept 2011 with No right of Appeal, Nov 2012 Received Romoval notice with right of Appeal, been in court in Dec 2012, Appeal allowed in Jan, received bio letter on Feb 18, did bio same day, been granted 30 months on 19 Feb.

Long and painful wait but finally get the status....

one important thing to share maybe it will help too many others, my partner is not a british or a setteled person, she is from Czech republic and been in UK 3.5 years, in start everyone had advise me its not possibel to get a DLR on European partner but my solictor advised me, it was the best option for me so i went for it...

Good luck to you all.

Kind Regards.

by the time we made application we were living togather 1.5 years and we were not married, so we wasn't going to quilify for 2 years unmarried partner as an EU partner though there were more chance with FLRO according to my solictor, so, i took his advise.

I suppose your application was expedited as your circumstance was what the UKBA will consider as a compelling one.

My application is through my british daughter born Dec 2011 my girlfriend is on ILR. I came on a student visa which i overstayed due to financial reason. I was told by lawyer i have a case using article 8 so i crossing my fingers...it has been a nightmare....
