Resignation: What doc should you get from your employer?

Post by netacct » Sun Mar 18, 2007 10:01 pm

Hi All,

When you resign from the company, what documents should you get from your employer?

My employer has refused to give Releiving/Release/Experience letter to some of my colleagues saying that it is against the data protection act.

TIA

Employers are not legally bound to give you reference letter (unless stated in job agreement earlier).

However, they usually give a letter stating only the date you've worked for them.

Don't forget the P45 form.

Your employer should give you a P45 when your employment with them ends.

There is no obligation on them to give you experience letters or references, this is at their discretion.

My friend did not even get his P45. The HR in his company refused to issue his P45 saying that the P45 is not issued to employees who resign while on-site.

I know this is a load of crap, but employers do act rather childish when their employees resign.

Was the company discussed an Indian IT firm?

They often dodge tax in UK. So didn't provide P45 form. I also didn't get mine. However, it is not a problem as you can fill up P46 form when you join new company.
