ILR on Tier 2 ICT

Post by vspv » Mon Mar 18, 2013 1:43 am

Hi
I'm bit confused about ILR eligibility. I have a gap of continuous 98 days gap but UK Salary was not paid for 83 days while I was absent.

Below is the Visa Details

1 WorkPermit April 20,2008 Oct 20,2008(UK entry on Apr 20,2008
2 Tier 2 ICT Oct 1, 2008 Oct 20,2009(Exit on Jul 12, 2009
3 Tier 2 ICT Sept 22,2009 Oct 30,2012(UK entry on Oct 18,2009
4 Tier 2 ICT Nov 1, 2012 Nov 2, 2015(still in UK.)

I was paid UK Salary from Oct 20, 2008 to Jul 27, 2009.
I was not paid UK Salary from Jul 28,2009 to Oct 17, 2009.
I'm again paid UK salary since Oct 18,2009 till date.
I'm working with Same Indian company through out this period.

Please let me know if I'm still eligible for ILR in April 2013 as I'll be completing 5 year with 97 days continuous gap and 83 day with no UK Salary.

Should not be a problem in my opinion if you get a valid letter from HR listing out your absences.

I agree.
In few posts I have seem member mentioning that if you do not have UK Salary paid for more than 1 month then its a problem. Is there any such rule for Tier 2 - ICT?

If you get letter from HR as suggested by some other member it will be fine. Please do share your experience which can benifit many others. Hats off to moderator for this excellent board.
