Absences during Tier1

Post by paba89 » Sat Mar 16, 2013 9:13 pm

Hi Guys

I got my Tier1 in Nov 2008 till Nov 2011 and entered UK in Feb 2009 ie more than 3 months. I got my first extention in July 2011 till Jly 2013. I got 2nd extention mar 2013 to Mar 2016. My 5 years will be completed by Feb 2014. And I will apply for ILR in early Feb next year. My wife got dep visa in sep 2011 till july 2013 and she got extension till mar 2016. So this is the scenerio and following are my queries:

1- I have been out of country to visit my family twice and have a plan for one more visit. i went for 3 wks in feb 2010 and 3 wks in nov 2011 and plans to go again for 3 wks in aug 2013. Do i need to provide documentary prove for these vacations. I was employed by an umbrella company when i was on leave for 1st holidays and than a director during nd visit and most probably in permanent employement for my next visit. Do i need to get letters from umbrella + accountatnt+ employer for vacations. What if they refuse to do so. My umbrella company is now shut down and they are doing business in another name. what should i do now.

2- My wife came to uk in nov 2011 and went back in jan 2012 but came back in mar 2012. she had plans to go back home for 2 months in august 2013. Acc to rules she needs to be in uk for atleast 2 years before she is eligiuble for ilr. Does these absences make any affect on her application. pls note that she is going to apply for ilr in feb 2014 with me.

Any advise and comments are much appreiciated.

http://www.ukba.homeoffice.gov.uk/visas ... ettlement/

1. Based on above link, on Tier 1 (G), you are allowed to be absent for 180 days in any 12 consecutive months.

2. For dependents, absences are not considered. You need to provide sufficient cohabitation proof of marraige subsiting.
