ILR Absence Days

Post by sudha_v » Mon Mar 18, 2013 5:18 pm

Hello,

I am on Tier 1 General Visa with my ILR due in April End. My absences are as follows

Year 5 157 days(all on business trips) (2012-2013)
Year 4 10 days (annual paid leave) (2011-2012)
Year 3 0 (2010-2011)
Year 2 30 days (annual paid leave) (2009-2010)
Year 1 25 days( annual paid leave) (2008-2009)

Total 222 days of absences from the UK in the 5 year period. I would like to know if I will be applicable under the new rule from 13th December 2012 where 180 days for any continuous period of 5,4,3,2 years is mentioned. Also, it says if there is a 180 days or more absence in a year then it will be a problem even though it has been business.
My business trips of 157 days I have been paid in the UK.
Will there be any problem regarding absences in my case. Please help.

Many Thanks,
Sudha

If you have calculated years backwards from the date of the application and still they are either 180 days or less than you qualify. However, you will need evidence of your absence, letter from employer or your self and pay slips etc.
Thanks!
