Hi everyone,

Can u guys please help me out with the following?

My friend is on Tier 2 Visa and he is in the following situation:


30/12/2009 07/10/2010 UK
08/10/2010 07/11/2010 India 30 days in India
08/11/2010 03/12/2010 UK
04/12/2010 14/03/2011 India 100 days in India
15/03/2011 06/12/2011 UK
07/12/2011 06/01/2012 Holidays 30 days vacation
07/01/2012 Till Date UK

As you can see he is out of UK for 160 days till date. He has finished 3 years 3 months.

My question is with the following phrase

"During the continuous residence period, you cannot be outside the UK for more than 180 days in any 12 consecutive months."

Does this mean 180 days in the complete 5 years or 180 days in each year?

This will help in plan his leave plans for the next 2 years.

Please advice.

The 180 days are in each 12 month consecutive period from the date of application towards backwards 5 years slot

Your friend is absolutely fine in terms of contnous period, just ask him to keep a letter from company that all his absence were paid holidays or on office duty as part of work.

Read this doc it is pretty clear on requirement
