UK Tier 1 ILR

Post by cuteprettysweetappealing » Tue Mar 26, 2013 12:19 pm

Hi Team,

My Visa Details:
I have a question about ILR.
I Got on tier 1 (general) on 3 Apr 2009
I Entered UK 1st Jul 2009
I Got extension on 13th May 2012 to 12 May 2014

My dependent family got Visa 1 Dec 2009 and entered Uk 20th Dec 2009.

Question
1. Do I need another extension before I apply for ILR or I can apply for ILR direct in May 2014?
2. If I can apply directly for ILR is my family also also apply ILR at the same time?

Regards

Post by cuteprettysweetappealing » Tue Mar 26, 2013 1:17 pm

Hi ali

Thank you for your quick response.

Coming to UK that I went to my home country 2 time for appx 3 weeks each.

What are you tiring to explain.

1. I mean is it ok for ME or for my whole family to apply for ILR. ?
2. Do you have any link where i can refer ?

Regards

ok

if you got T1G in april 09 it would be

03 April 09 - 02 April 12 but you entered UK 1st July (89 days later)

Then you would have applied for extension

Which would have been granted

13 May 12 - 12 May 14

1 . If this is right then you do not need any extension as you would have spent 5 years on T1G by May 2014 and you do not need any extension

2. Your family joined you 20th Dec 09 and they would have spent more then 2 years by May 14 so they are ok to apply with you as far as they have LIUK and 2 years cohabitation documents to prove you are living together

Page 11 of 18 Guidance –ILR – calculating continuous period in the UK – v7.0. Valid from 23 January 2013
The period between entry clearance being issued and the applicant entering the UK may be
counted toward the qualifying period, as long as it does not exceed 90 days. This can occur
if the applicant is delayed travelling to the UK. Provided the period of delay does not exceed
90 days, it will not be counted as an absence
I hope I have answered properly this time, Good Luck
