ILR for spouse with < 2 year living together period in UK

Sorry a quick synopsis.

EC stamp date is 21 Feb 2008. Came to UK on April 5th 2008.

In total I was away from UK for 225 days but year on year from the date of application I was away for less than 180 days in a calendar year.

Kindly let me know whether I am eligible for ILR and coming into the context, my wife had 3 years of Tier 1 dependant visa but was away from UK due to pregnancy. The total number of living together period in UK is less than 2 years (1 Year 8 months).

I am planning to take the risk and apply ILR for my wife as well. Any thoughts or advice welcome. Thanks.

I'm not quite sue if you are eligible for PR, but if you are eligible I think chances of getting ILR for your wife is high as with previous responses from this thread..

When you are planning to apply for ILR ?
Through Post or PEO ?
Did u book any dates ?

Hi All,

Got ILR for myself and my dependants with less than 2 years cohabitation in UK.

No question asked. All done in less than 2 hours.

Venue : Croydon PEO

Form used : SET 0

I think all in the covering letter and we got to touch the issues but not elaborate much and for Tier 1 G they look whether you are financially active. The CW just saw my employment history and specific pages in SET 0 abt last 12 months consecutive employment.

From previous posts, it looks like you can take a chance and apply for ILR to your wife. When you are planning to apply for ILR ?

Iam also in the same situation as above, my ILR is due in Sep-2013.
I got married in Dec-2010, as my wife already got Tier 1 visa i didn''t changed her into my dependent until Dec-2011.
Is she eligible for ILR in Sep-2013 as my dependent???
By sep-2013 she will be completing only 21 months but
as per new rule is she need to be in dependent visa for 2 years (24 months)???

Any experts please advise>>>>>

I have a query re ILR for my wife, wondering if someone can help.


I am a Tier 1 (General) visa holder and I am applying for ILR in July 2013. Since Sep 2009 my wife is holding a dependant visa and stayed with me in the same address.

Though she is continuously having dependant visa since 2009 to till date, she had spent continues 10 months in India during her pregnancy (i.e from Nov/2011 till Sep/2012).
She was here continuously for 2 years (from Sep/2009 till Nov/2011) and then been to India for, 10 months(as stated above). Despite of her 10 Months stay in India, Is she eligible for applying ILR with me?

I called home office and has got mixed replies.Can some one help us out?

There is no need to medical certificate, if you have any other supporting documents thats fine for example hospital report or birth certificate of kid will suffice , these are required only if they ask.
most of times they will not question.
co-hab documents which i have taken/given are in the link I have provided.

Hi ilrdep,

Our case is almost similar to your case regarding ILR eligibility for dependent(spouse/Partner).Could you please provide the sample letter that you got from landlord as proof of residence(2.5 years which you have stated in your case and 2.3 years in our case).
I just need the template ofcourse you can delete your details.It will be very helpful for us.

Hello All,

My husband along with our son & myself are going for ILR next week, on the 5th of August. We have booked our appointment at Solihull PEO.

Though I have not stayed continuously for two years in UK, we are taking a chance after reading the success stories in this forum. Many thanks for giving us this confidence! I came to UK in Nov 2010 on dependant visa and went to India in June 2011 to have my baby there. Then returned to UK in June 2012 after an absence of 1 year and staying here since then. We are taking a chance based on the fact that I have completed two years in the dependant visa and we have proof of cohabitation such as bank statements, council tax bills & NHS letters.

My current visa as dependant of Tier 1 migrant is valid till March 2014, and if I am not granted ILR along with my husband, can I stay with the current visa till it expires? Please can someone clarify me on this query?

You should be fine if you got visas before 9th July 2012 and have consistent cohabitant proofs.

One of my friend would go this week for his PEO appointment at Croydon and I would update you his result, his case is exactly the similar ones what we have here. Both husband and wife came on individual tier1s and they didnt switch to each others dependant visa untill 2011 and then wife became husbands dependant in Dec 2011(EC from Delhi). Husband is elligible for his ILR, so he is going with his wife and daughter. Daughter though born in UK but they are not interested in BC so prefer staying on ILR with Indian passport.

Hi,


My back-ground is WP+Tier1 (general) +Tier 1 extension,

Initial entry date on WP: 1st June 2007

Tier1 (General) – Initial application granted – 1st Sep 2008

Married in Feb 2011 – Wife entered UK on Tier1 PBS dependent visa on 20th may 2011.

Tier1 (general) extension both for me and my wife – 1st Sep 2011 valid till 1st Sep 2013

She left UK on 25th Sep 2011 and returned on 26th July 2012 for Maternity purposes with baby with Indian passport and my child has Tier1 dependent visa valid till same as ours.

I took decision to apply along with her seeing so many success stories, I applied at Solihull PEO yesterday, 30th July 2013.

I applied with wife and child as well on same set-o, 1 main + 2 dependent got my ILR approved & childs but Wife application got refused. :shock:

Refusal reason, she did not live in UK for 2 years.

She had 16 months out of 26 months in UK and that is why she is asked to make a PBS dependent extension and then apply with Set-o.

I have provided both Indian doctor certificate and our GP letter to show that she stayed in India for medical reason but still CW dint consider this, he said the rule is lived in UK for 2 years so it was refused.

I will say if you want to take risk don’t take it at Solihull PEO.
