Tier 4 rules

Tier 4 rules

I came in UK on 6th April 2005 as student (stayed about 5 years on level 7), then complete master’s degree in year 2010 from university and switch visa to PSW category. During my PSW leave period tier 4 PBS introduced. At the end of my PSW work permit leave in 2012, once again I switch to Tier 4 PBS student visa in level 7 from “A” rated college. I was granted leave to remain from October 2012 to October 2014 with zero work hours.

Now as for current Tier 4 rules student can’t stay more than 5 years on level 7 or below level of education.

As now I am thinking to change my sponsor a highly trusted college in same level in Masters in education course. My concerns are:

1) If UKBA refuse my change of sponsor application (considering as a new application) what will happen to my previously granted leave to remain in Tier 4 PBS category

2) And is there some chance they allow my application

For new application, you need new CAS which mean previous CAS need to be cancelled coz you cannot have two CAS at the same time. When previous CAS cancelled you current visa will be terminated which was issued on the basis of that CAS.

New visa should be issued on new CAS. But, you are no eligible for any new visa as you already spent more than 5 years on same course. There is no chance of any chance coz UKBA daily refusing student visa extensions on these 'cap' regulatons.

Thanks mate for this prompt feedback. The 5 year rule was introduced in 2010. after 2010, I have not stayed at/below level 7 for more than 5 years.

My dear..Rule introduced in 2010, but applicable retrospectively. Mean all students who study in UK on student visa comes under this rule. So there is no question of after or before 2010.

If this rules apply retrospectively then why this guy was given a two year student visa in 2012 when he already stayed for about 5 years in student category at level 7?
