are we doing anything on legal front?

Post by ilr_trauma » Mon Mar 18, 2013 8:43 pm

are we doing anything on legal front? is solicitor contacted..can we setup some webpage for donation for legal fees? can we send legal notices...

i think the way minister tried to rationalise increase, we have very good chance of winning the case...he shouldn't have tried to justify saying 'those who benefit should pay'
work visas are for benefits of both - employee and employer (and so govt and UK economy) This is indirect taxation

even if increase is rolled back we should still fight for existing high fees...

Hold on, we need to see what the Govt replies. One of our MPs (or many) will speak to the government and we need to wait until we receive a proper reply.

The process in the UK is we cant file a lawsuit until we have first got a proper reply from the other side, or the other side refuses to reply for a reasonable amount of time.

Meanwhile, I'm targetting a minimum of 100 people to register, so far we have reached 33.

Ram I am with you, lets get 100 people to agree, then let have a meeting point agreed and have an open invite to as many people who can come and meet up.

Regardless of the response I say we still contest the govt. even last year they have increased the fee from £1000 or smthing like that to £1500. I think we should go ahead in court.

Come to think of it , the fee increase is highly biased
: Check out this statement:
These increases are mostly in line with inflation and will ensure that the UK continues to welcome the brightest and the best. It is only right that those who use and benefit from the immigration system should contribute more than the UK taxpayer.'

SO MY QUESTION IS DO THE FOLLOWING VISA HOLDERS HAVE A DIFFERENT BENEFIT OUT OF THE IMMIGRATION SYSTEM ? ARE THEY NOT ENTITLED TO HEALTHCARE, SCHOOLING, AND THEN ULTIMATELY PERMANENT RESIDENCY AND CITIZENSHIP !

Tier 1 – Graduate Entrepreneur Standard - main
£700
£406
Tier 1 – Graduate Entrepreneur Standard CESC - main
£630
£365
Tier 1 – Graduate Entrepreneur Standard - all dependants
£350
£305
This is clearly a biased view and i think we being no lawyers are able to create such valid arguments , if we fight against the govt. we could get this down to a 3% increase from 2008 onwards.

I am not good at Facebook and tried to create a group but could not come up with an option, Does anyone of you know how and if you could create a group "FIGHT AGAINST HIGH IMMIGRANT VISA FEE RISES IN THE UK" i think it would be worth it.

Guys lets go for it !! are you in ?

I am with you all in this petition being signed and getting this highlighted to MPs that why are the fee hikes so steep.

Do you think getting this highlighted in the media will help putting some pressure on government that why all the axe on PBS migrants.

I think we should wait for the governments response on this first, before taking any action. But that shouldn't stop us from creating strategies to prepare for any eventuality.

i am with you

Post by mian1 » Tue Mar 19, 2013 5:34 pm

hi
i am agree with you, while we are only on immigration board we are not getting enough support and even the migrants don't want to speak for this injustice with them, because most of them belongs from the countries where no one listen and they are not used to put their voice or their vice not listen and they left the country.

In March 2011 For Postal Application of Tier 1 initial
850 Main Applicant
250 Dependent

in March 2013 For postal application for Tier 1 General Extension
1500 Main Applicant
750 Dependent

Let your Friends know that we are targeted by UKBA
when 2011 Tier 1 General Applicant will reach for ILR in 2016 the Fee for
ILR application and their dependent will be about

2500-----3000 for main applicant
1800-2500 for dependent and it will be for each dependent under 18

Let them do think and speak now or never
no one speak April 2011 and the Fee shout to higher
if no one speak now it will go more higher and higher

Response from my MP as follows:

As you are aware the minister of state for immigration made a written ministerial statement on 14th March to provide details on the proposed fee increases however there was no debate or vote held in the house of commons in this matter.

As such i have written to the minister of state for immigration to ask for his comments on the concerns you have raised.

Fine print in the fees increase document

Post by kbcbala » Sun Mar 24, 2013 12:59 pm

rdamsel wrote:UKBA is very smart .

Main applicant before 6th April 2013 PEO : £1800

After 6th April 2013 PEO : £1920

Means an increase of £120 ...
( Fair Enough for people who pay lots of money to the booking agents for PEO)

However:

Dependent before 6th April 2013 PEO : £900

After 6th April 2013 PEO : £1159

Means an increase of £259

...

Main applicant increase is less because main applicant is one off person where as he might got 2 or 3 dependent means jackpot for UKBA.

UKBA knows how to make cash ....

I am thinking to take a money making crash course from them
:D
-- http://www.ukba.homeoffice.gov.uk/sitec ... s-2013.pdf

The fine print in the page5 says:
Dependants’ fees
are for applications made at the same time as the main applicant. For
PBS dependants applying individually the relevant main applicant fee is payable.

It is even worse if the Dependant and the main applicant separately.
It says that the dependant has to pay the relevant applicant fee.

which is like rubbing salt in the wound

This is the current fee in effect:

http://www.ukba.homeoffice.gov.uk/visas ... eral/cost/

It has not changed since last year, the pdf document is only a proposal and it has not gone thru a formal approval.

This does not look correct as you can see the New increasedapplicable fee on the next page. Agreed we havent seen any new on passing the proposal but I dont think "absence of news matters.

Post by hsyasin » Wed Mar 27, 2013 2:52 pm

Hi all,
Can experts or someone please confirm what fees will be applied to dependants applying from outside of UK??
As, I can't see any mention of changes to Tier1 General dependant fees.

Ram how many of us are in London ? Can you provide some statistics.

Next Step - We meet with each other in person, depending on where most of us live

- Get a confirmation from those who are willing to pay

- Get in touch with HSMP forum guy

- Get a strong solicitor on board.

We need to take action !!!

There was no doubt that the fee rises would be passed by Parliament. What does parliament care about the rights of non-citizens?

57 people now registered. How many are in London is not known, but I am.
