Post by ric1982 » Tue Oct 16, 2012 1:35 pm

Hi,

Background:

Father British by naturalization (Born in India as an Indian citizen)
Mother ILR (Indian citizen)

Question:

Which citizenship the new born baby will be eligible for if
(1) Born in India
(2) Born in UK

Thanks

1. British by descent
2. British by birth.
The only difference being that the children of a child born under 1) will not be British if they are born outside the UK. BC is passed down only one generation when outside the UK.

Thanks. If they are born in UK could they be registered as Indian?

Yes. Birth of the child should be registered with HCI within a year of birth and you will need to provide evidence that the child has not acquired British nationality.

sushdmehta,
When you say 'Birth of the child should be registered with HCI within a year of birth and you will need to provide evidence that the child has not acquired British nationality.'. After that (only registering birth with HCI and not take Indian Paasport), if I apply for British Passport for my kid, do my kid has to still wait for 18 years to obtain the Indian Citizenship?

Alternatively, from http://www.immigrationboards.com/viewtopic.php?t=119681 I know there is some process to apply for Indian Passport and then apply for right of Abode/entitlement? I didn't understand once I get this righ of Abode, do we need to then apply for ILR on Indian Passport for my kid? Please share your thoughts.
