ILR Successfull: query for wife

Dear all,

Firstly a big thanks to this forum and specially to Kevin, wpilr, cs95td, srk2012, uk_2010 for the help through my ilr journey. I appeared for my appointment in solihull on 26th and got my BRP yesterday. i am in touch with several forum members who are appearing for their appointments in the coming weeks and will be happy to provide inputs to anyone i can help, please feel free to pm. I will be shortly posting my peo experience in a seperate post.

I need an urgent help regard my wife's case to determine if any urgent action is required.

my wife's case
Visa type: tier 2 ict dependent
EC Stamped date: 24/11/11
UK Entry: 2/12/11
Current visa expiry date: 18 December 2014

Query: now my ilr is done and she has not completed 2 years in the uk. Can:

A. she continue on her current tier 2 ict dependent visa until December and post that directly apply for ilr or will this cause an issue

Or

B. should we immediately apply for a flr(m) now and then later apply for ilr when she competes 2 years

Or

c. Can she now itself apply for ilr as her current leave to remain is valid post dec 13 I.e. when she will become eligible for ilr.

On what category you were in, your history for 5 years and what documents you were asked?

Also a bit more details on the processing timelines would be useful.

Sure mate, here we go, apologies for the terse English as I am using my mobile
Visa status: on wp+wp+t2+t2
My total days outside uk were under the 180 day limit
Docs asked: brp, passport, payslips, emp letter, bank statement, photos
Timelines: entered peo at 9.30, issued token at 10:00, called in at 10:50, interview took 20 mins, payment took 20 mins as there was some delay for the person before me, biometrics were immediate followed by 2 hours wait for the approval letter.

Regarding your query , vinny is correct also do not go for FLR(m) option because as per new rule your wife will have to then wait for 5 years in ILR dependent visa to get her own ILR.

Congratulations. Good on you Mate! I was wondering what has happened to you. Happy with what ever help I was able to give you for your ILR. Pl. Post your experience. If any queries I will post??

Dear Board Members: Would be really helpful if you can answer my query below:

Query Background:
>> My wife entered UK on 02/12/11 on a Tier 2 ICT PBS Dependent: 12 month visa
>> Visa got extended in 2012 for two years and is valid until dec'2014
>> I got my ILR approved in Mar'2103
>> We didn't get my wife's visa converted to FLR at that point in time as it would have brought her under the five year rule
>> I changed jobs in sep'13 and I think that my employer may have notified Home office regarding curtailment of my sponsorship(this didn't affect me as I had already shifted to ILR by then)

My Query:
I am now planning to apply for my wife's ILr under the 2 year rule as she came before July'2012, my queries are:

A/ Which form do I need to use Set-O or Set-M
B/ Will my wife's PBS dependent visa cause an issue as the main visa holder i.e myself has shifted to ILR which has left the tier-2 visa ir-relevant and hence this may have caused the dependent visa to be curtailed
