Am I eligible to apply for ILR tomorrow? pls confirm

Hi All,

Any info will be highly appreciated.

Entered UK on 25/05/2008
WP granted in Banglore, India on - 28/04/2008.

I will be completing 5 years on 25/05/2013 so I am actually eligible to apply 28 days prior to this, so the date I am eligible is 27/04/2008. But as I have travelled with in 90 days from the time my WP is issued for first time, the document of UKBA says I can consider the date 28/04/2008 as my first clearance date. So now please confirm me if I am eligible to Apply from Apr 1st 2013. I have my appointment on 03/04/2012. The reason I am applying quick is to apply before 6th Apr when the new fee comes in to existence.

Please find the rule in 11th page 3rd paragraph

The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period , as long
as it does not exceed 90 days. This can occur if the applicant is delayed traveling to the UK. Provided the period of delay does not exceed 90 days, it will not be counted as an absence.

You can not apply earlier than 28 days before the 5 year, starting from entry clearance date. So earliest you can apply is 27/04/2013. YOU CAN NOT APPLY ON 03/04/2013.

Read the documentation again and you will understand.

Thanks I know that we are eligible to apply only 28 days before 5 year completion. Couple of my frnds had a similar situation like me and their application was successful. As this Forum has wider audience and experts I want to confirm again before I travel 150 miles.

Please stay away dont give your one liner answers which is of no use like Read the documentation again blah blah without telling me the reason. I am not an expert at these UKBA issues. Thts why I reached out for help here.

You said it yourself - you are eligible for ILR 28 days before the fifth anniversary on your date of entry clearance. NOT 56 days before or some such.

What you have quoted says that you are eligible to apply for ILR 28 days before your fifth anniversary AS LONG AS you entered within 90 days of that date. All very confusing, as we know.

Well that is totally different to whatever you posted first.

So your qualifying period starts from 28/04/2008. Earliest date you can apply is 31/03/2013. Applying on 03/04/2013 is absolutely fine.

You are making a massive assumption about me and my understanding of the myriad rules and rule changes. How dare you.

Your initial post seemed contradictory in itself as if YOU had never heard of this before. It would be quite clear to anyone who had heard of this rule to be able to interpret for themselves whether or not they qualify for themselves - but you were unable to do so and asked for advice from others. Any idiot who had done the research (which you did) should have been able to assess the situation for themselves. But it is on this point that I am time and again proven wrong!

I had called UKBA helpline today and they mentioned that it will be fine so good luck for your application.
