Tier two visa might be invalid need urgent help please!!!

Post by patcab » Thu Apr 04, 2013 1:56 pm

hi! can somebody help me?

I sent my Tier 2 application 1 day ago via post to UKBA and paid with my debit card, unfortunately the card I used was lost and my bank had to block it and send me a new one, I rang UKBA explained what happened and asked if I could use another method of payment and they said no, my application would be sent back to me as an invalid application because of the payment.

Iam changing employers but I'm still under my tier 2 visa from my old employer and will still be valid until sept 2013. My concerns are:

1. do I need a new CoS from my employer to submit a fresh application? (my current Cos will expire on june 15 2013) or can i still use the one i sent before?

2. how long does it usually take for UKBA to send back my invalid application? Iam changing employers and they want me to start by June if not they might withdraw my employment with them.

3. If i make a fresh application do I need to explain to them what happened and why my previous application was invalid?

I would really appreciate any help i could get as i am very stressed about what happened. Thanks in advance!! :(

If an application was invalid, then I believe it's like that application had never been made.

Hello

The only way around it i can think of is if you fill in first two pages of application with the New payment card details and post it along with a letter stating the situation. Otherwise it will just take ages as the invalid application take months to come back ... In fact if you can send a cheque be better.

good luck

thanks for the reply! I rang UKBA again and asked if i could just send a cheque or the payment pages of the application they said that it will just complicate the situation and will probably not work. So i'm really worried now that it would take months before i receive my documents back.

another thing, does anyone know how the changes in UKBA from april 6 will affect the application process for tier 2?

hi thanks vinny, that's what I am planning to do. I'm just worried about the waiting time to get my documents back, because my employer might withdraw my job offer if I don't start by june. do you happen to know how long is the average time of wait before i receive my documents back?

As long as a decision on an application has not been taken the application can be varied. Rather than wait for the rejection you could try to vary your application by submitting different card details or a cheque.
Read page 33:
http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

According to the guidance applying for a variation is possible if the applicant wants the grant of leave to be considered "on a different basis". It is arguable whether a different payment method is a "different basis" - but it is worth a try. In fact it would be sufficient just to re-submit the payment pages (as Freeman78 suggested) with a covering explanatory letter requesting the variation of your initial application.

Hello Manci and others,"varying the application on different basis",does that mean can I vary my application from tier2(SOC) to Tie2(General)?
